A
MONOGRAPH FOR NEW CLIENTS
The
Center for Peer Review
Justice is run by a
healthcare provider who has
special skills in resolving
intractable problems for
physicians who have run into
both peer review and
employment problems. It is
no secret to the practicing
physician that despite many
years of education, he/she
is ill suited to life
outside of being a
physician. The training you
received and the hard work
you put in does not
translate well to other
classifications of
professional income. Some
physicians are fortunate
enough to get a job with
insurers or specialized
clinics. But often, past
peer review adverse
experience results in your
not being able to qualify
for such employment. You
became a physician. That
remains your best place.
LAWYERS
AND SHAM PEER REVIEW
The Center for Peer
Review Justice will work closely with any
licensed legal provider of your choice. Often
they wish to take the
"dominant"
position both because we cannot provide legal
services, and even more importantly cannot
usually charge the same level of fees they do.
Graphically stated, they want the high fees for
themselves. We recognize this and find that they
still have your best interests at heart. Some
lawyers have excellent experience in Sham Peer
Review, but typically their fees are at least
500/hour. Even just six month's experience with
said counsel will bankrupt most physicians,
especially if they are terminated from their job
as a physician. The Center for Peer Review
Justice has a
"stable"
of experienced, licensed
legal counsel who understand
sham peer review and have
the guts to do it right. We
are not suggesting that you
terminate your present
counsel, and they will most
seriously criticize any
suggestion that you do. We
just want you to understand
the total picture.
LEGAL
ADVICE AND THE CENTER FOR
PEER REVIEW JUSTICE
Richard
Willner does NOT provide
legal advice. If you have legal questions, you
are strongly advised to seek licensed legal
counsel. This is no place for anyone to play
" amateur lawyer."
And that includes us. If you
ask us a legal question, we
will refer you to either
your counsel or ours.
WHAT DO
WE DO?
The
following is a brief list of
our services. We have
accomplished this for other
people who WERE in the same
place you are now. This is
not a fantasy. We have
actually achieved these
goals.
-
Working with peer review
panels directly and
indirectly to achieve a
new sense of
communication and trust
between them, us and
you, even in cases of
sham peer review.
Examples can be found on
our long lists of
satisfied clients. We
are able to achieve this
because even in cases
where a particular
member of a peer review
board wishes to see your
destruction, we can
often separate them out
and work with other
members of the voting
committee, instead. You
may be surprised to
learn that some
committee members could
support your side.
-
Finding you a paying job
as a physician: We have
a history of being able
to find jobs and get you
licensed in states that
will accept your "difficult" and complex history. You
may think it is
impossible. We have
thought so as well, but
still managed it.
-
De-listing you from some
negative history of the
NPDB. Contrary to
popular belief,
sometimes it is possible
to cancel some of your
negative history. This
has been done. We cannot
guarantee this in YOUR
case, but we know how to
try to do it. We have
been successful, often
to our own great
surprise.
-
Obtaining malpractice
insurance for you: We
cannot guarantee our
results, but we have
connections with people
in the MP insurance
industry. You do not.
-
Working with you to
solve difficult
psychological and living
patterns that are
ultimately
self-destructive to your
ability to work and be
accepted as a physician.
We have counselors on
our staff who know what
you are facing,
including some of the
evil that is being
directed against you and
your family. The sham
peer review process can
damage you, especially
over a period of time.
This causes many
symptoms: despair,
anger, rage, hostility,
genuine medical
depression, suicidal
ideation, excessive
self-criticism and
family arguments. Those
are just the emotional
sides. We haven’t even
talked about the
FINANCIAL side!
-
If you are contributing
to your own destruction
by your thinking and
acting out, that will
NOT benefit your
situation. We know
because we have seen it
all. You need us to
point that out to you,
and listen to what we
say.
-
Prevention and reduction
of jail time.
-
Help you form new
alliances with people
who can help you. You do
not know these people.
That is part of your
present problem. We know
them. Some have been our
past clients. They are
in a position to help
you. No. You cannot do
this part by yourself,
or even with your own
legal counsel. They do
not have the connections
we have.
POVERTY AND LACK OF
WORK
HOW CAN I PAY THE
FEES OF THE CENTER FOR
PEER REVIEW JUSTICE?
Most of our clients have
been out of work as a
physician for at least a
year. Few have any
alternative skills that
provide even a 10th
of the income they used
to have. Your lawyers
have already denuded
your savings. You have
nothing left.
If
the Center for Peer
Review Justice finds you
a paying job as a
physician (one of the
best results), we expect
you to pay us for our
services. Those can be
negotiated. We can also
negotiate hourly
services if you wish to
avoid future "entanglements."ť
You have to pay us on
time. We cannot and will
not tolerate
game-playing, even if it
is necessary for you to
drive a cab to make the
payments. Unless you
value our services, you
will not value yourself
either.
CLASSIFICATION OF
VICTIMS OF SHAM PEER
REVIEW
-
Straight and
uncomplicated sham peer
review—you are under
peer review by a
committee of your
hospital, clinic or
specialty. Because you
have been successful and
had more hospital
surgical admissions,
your competition is out
to get you any way they
can.
-
Excessive Data Banking:
You have many lawsuits
against you, some of
which are well justified
and many settlements
that have resulted in an
extremely adverse effect
on the ability to obtain
malpractice insurance
and/or employment as a
physician
-
Fired from
hospital/clinic service
for cause: The “disruptive”
physician and the
negative effects on your
career.
-
Prior criminal or new
criminal history
unrelated to medicine:
DUIâs, spousal abuse,
substance abuse, drunk
and disorderly arrest,
public exposure charges,
etc.
-
Loss of license for
cause by your medical
society
-
Various and mixtures of
the above
UNDERSTANDING THE
KARPMAN DRAMA TRIANGLE
In
the branch of psychology
called "transactional
analysis" there is a
construct called the "Karpman
Drama Triangle"ť (KDT).
It is vital that all of
our clients clearly
understand this
important subject. It
may seem like an odd
discussion at this time.
The reasons for it will
become clearer as we
work together with you.
We also encourage you to
look it up on the
Internet.
There are three elements
to this behavioral "system."
They are the “rescuer,
the victim and the
perpetrator.” Each of
these positions is toxic
and not conducive to
adult behaviors. When
you join one role, you
tend to switch between
them at various times.
It is difficult to
completely explain this
behavioral system in a
few paragraphs. But it
is safe to say that most
victims of SPR are
bogged down deeply into
it. It is time for you
to stop seeing yourself
as a victim and take a
pro-active part in your
own defense and
survival. You made it
through medical school.
You can do this too.
Along with stopping
behaviors of the KDT,
you will stop trying to
seek revenge or become a
perpetrator. The real
goal is for you to live
your life well and with
lots of money. Freeing
yourself of vengeful
thoughts directs you to
constructive and
fulfilling new
directions. This is not
psychobabble. This is
the truth. WE will NOT
enter the KDT with you.
You must resolve to
follow our advice. Not
because we are better or
more intelligent than
you are. But because we
have seen it all and
know what we are doing.
Your responsibilities to
us and yourself:
-
Pay your bills to us on
time and completely, as
negotiated
-
Send us all the data you
have available about
your situation
immediately, even if it
costs you money to do
this. Work at McDonalds
if you must to raise the
money to do this.
-
Don’t tell your
friends or relatives
about your
personal/professional
problems
-
You cannot afford to
live in the place you
presently have. You must
cut expenses
immediately, especially
if you lost your job. A
rental apartment is
excellent because you
have the freedom to move
to another job that we
might find for you. Put
most of your stuff in a
storage unit, or sell
it. Definitely seek
month to month rental.
Learn skinflint living.
-
Spousal support: It is
excellent if your spouse
can get a job. He/she is
probably used to your
high income. Those days
are gone; optimistically
for at least for 2-3
years. Hopefully this
will not end in divorce.
Seek marital counseling.
It definitely helps.
-
Very few physicians are
prepared for the
economic impact of
losing their job and not
being able to find
another one immediately.
Your kids may not be
able to count on you to
send them to college or
private school. If you
are divorced, your
ex-spouse and
non-custodial children
will have to learn to
live on less. You MUST
plan for this. Face it
like an adult. Avoidance
of these
responsibilities puts
you into the Karpman
Drama Triangle.
-
Alternative professional
employment for
physicians is rare. You
need to find a job. A
job selling cars,
computers, teaching,
etc. are possible. If
you don’t have a
negative criminal
history, a teaching
certificate is a good
goal. Do it on-line if
you can. You need to
work during the day.
-
The sooner you face your
new-life the better off
you will be. Don’t
call yourself doctor.
People won’t hire you.
Just tell them you are
“retired” and doing
this out of boredom. No
job is beneath you or
below your abilities. We
have had clients take
many different
opportunities for
employment.
Astonishingly, despite
not being professional
they really help heal
you and your
self-esteem. This is the
totally unexpected
results of facing your
life and not entering
the "victim"ť roll.
It is amazingly
empowering!
-
You can do this. Other
people who have been in
a worse condition than
you are have triumphed!
We know you are used to
societal recognition as
a physician. The sooner
you give up that roll….ironically….the
better the opportunity
and likelihood that you
will get back into it.
-
While working with us,
we might recommend
psychological and
employment counseling.
It is YOUR obligation to
fulfill that
requirement, whether you
believe we are correct
or not.
Sincerely yours,
Richard Willner, DPM,
Center for Peer Review
Justice
